Please read these terms and conditions carefully before using Our Website as they affect Your rights and liabilities under law. By using this Website or making a purchase either electronically via this Website, or by phone or fax, or in person, You agree to be bound by these Terms including Our Disclaimer and Privacy Policy..



1. Definitions and Interpretations



1.1 In these Terms the following words shall mean:

1.2 In these Terms, references to “in writing” shall include e-mail. Any queries regarding these Terms, the Goods or Your Order must be made to the Contact Address.



2. Goods Information



We have made all reasonable efforts to accurately display the sizes, colours, shapes and patterns of the Goods for sale on Our Website. You acknowledge and accept however that sizes, colours, shapes and patterns shown on the Website are approximate only. Colours in particular may differ due to Your own computer visual settings and hardware.



3. The contract between you and us



3.1 We must receive payment of the whole price for the Goods that You order before your Order can be accepted. Once payment has been received by Us We will confirm that Your Order has been received by sending an e-mail to You at the email address You provide in Your Order Form.



3.2 You have the right to cancel the Order up to the point at which the Goods are dispatched by Us. If you wish to cancel pursuant to this clause then You must notify Us in writing. Should You cancel Your Order before dispatch We will refund in full the amount forwarded by You within 21 days of the Order being cancelled. Credit card charges will be refunded on the same credit card only. Our acceptance of an Order does not take place until dispatch of the Order, at which point a purchase contract will be made.



4. Price



4.1 Subject to this clause 4, the price payable for Goods that you Order are as set out in Our Website;



4.2 The prices payable for Goods exclude delivery charges. Delivery charges are shown separately when ordering Your Goods. Further details on delivery options can be found in the General Information section of this Website.



4.3 Prices are subject to change without notice.



4.4 Prices are inclusive of VAT.



4.5 The Price is exclusive of any import or export duty.



5. Right of Cancellation



5.1 Notwithstanding clause 3.2 and subject to your compliance with the remainder of this clause 5, You may also cancel Your Order at any time up to the end of the fourteenth (14th) working day starting from the date immediately after you receive the ordered Goods provided those Goods are unused, with all labels and tags intact and attached and in no worse condition than when they were received by You.



5.2 To cancel your Order You must notify Us in writing at Our Contact Address before the end of the period set out in clause 5.1.



5.3 All cancellations should be undertaken in accordance with and subject to Our Returns Procedure set out in our General Information section of this Website.



5.4 You must send the Goods back to Our Contact Address at Your own cost and risk. If Your Goods included an unused Freepost label then You may use this for returning Your Goods but You accept that You are still responsible for the cost of any packaging and risk. If Your Goods do not include an unused Freepost label then You are responsible for the cost and risk of sending the Goods back to us (including package and posting).



5.5 Once You have notified Us that You are cancelling Your Order, any sum debited to Us from Your credit card will be re-credited to Your account as soon as possible and, in the event that the Goods have been dispatched, within NETQUOTEVAR:21 days of your cancellation notice PROVIDED THAT the Goods in question are returned by You and received by Us in the condition they were in when delivered to You and in their original packaging. If applicable, We shall be entitled to deduct the direct costs of recovering the Goods from the amount to be re-credited to You.



5.6 Refunds under clause 5.5 can only be made to the original payment card.



6. Cancellation by Us



6.1 We reserve the right to cancel the Contract if:



a. We have insufficient stock to deliver the Goods You have ordered; or



b. We do not deliver to Your area or country; or



c. if one or more of the Goods You ordered was listed with incorrect information including without limit price, and/or description for whatever reason; or



d. if We have reason to believe that You will fail to pay for the Goods or that You will not comply with these Terms.



7. Delivery of Goods to You



7.1 Subject to clause 7.4, We will deliver the Goods ordered by You to the address You give Us for delivery at the time You make Your Order.



7.2 Delivery will be made as soon as possible after your Order is received and no later than 4 weeks from when We accept you Order.



7.3 You will become the owner of the Goods you have ordered when they have been delivered to You. Once Goods have been delivered to You they will be held at Your own risk and We will not be liable for their loss or destruction.



7.4 We will not deliver to a PO Box address. We also reserve the right not to deliver Orders if We believe the address is not secure, for example a communal postal address.



8. Liability and Limitation



8.1 If the Goods We deliver are not what You ordered or are damaged when You receive them or the delivery is of an incorrect quantity, We shall have no liability to You unless you notify Us in writing at our Contact Address of the problem within seven (7) working days starting from the date immediately after the delivery of the Goods in question.



8.2 Save as precluded by law, We will not be liable to You for any indirect or consequential loss, damage or expenses ( including loss of profits, business or goodwill) howsoever arising and in any event our maximum liability to You shall be to refund to You the amount paid by You for the Goods giving rise to the claim.



8.3 You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase Goods from Our Website. The importation or exportation of certain of our Goods to You may be prohibited by certain national laws. We make no representation and accept no liability in respect of the export or import of the Goods you purchase.



8.4 Notwithstanding the above, nothing in these Terms is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to You for any death or personal injury resulting from Our negligence.



8.5 You acknowledge and accept that save as expressly stated on the Website We give no representation, warranty or statement as to the Goods including without limit their quality and/or suitability.



9. Notices



Unless otherwise expressly stated in these Terms, all notices from You to Us must be in writing and sent to Our Contact Address.



10. Events beyond our control



We shall have no liability to You for any failure to deliver Goods You have ordered or any delay in doing so or for any damage or defect to Goods delivered that is caused by any event or circumstance beyond our reasonable control including, without limitation, strikes, lock-outs, terrorism and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.



11. Invalidity



If any part of these Terms is unenforceable (including any provision in which We exclude our liability to You) the enforceability of any other part of these conditions will not be affected.



12. Privacy



You acknowledge and agree to be bound by the terms of our Privacy Policy.



13. Returns procedure



You acknowledge and agree to be bound by the terms of our Returns Procedure.



14. Third party rights



A person who is not a party to this Contract has not got any rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any terms of this Contract but this does not affect any right or remedy of a third party that exists or is available apart from that Act.



15. Governing law



This Contract shall be governed by and interpreted in accordance with English law and the English Courts shall have jurisdiction to resolve any disputes between us.









16. Complaints



If You have any concerns or complaints about the Goods, this Website or the service You have received then please write to the Contact Address.





17. Entire Agreement



These Terms, together with out current Website prices, General Information document and privacy policy, set out the whole of our agreement relating to the supply of the Goods to You by Us. Nothing said by any sales person on our behalf should be understood as a variation of the Terms or as an authorised representation about the nature or quality of any Goods offered for sale by Us. Save for fraud or misrepresentation, We shall have no liability for any such representation being untrue or misleading.







Making A Purchase Making a purchase could not be easier. Just browse our store, and add any items that you wish to buy into the shopping cart. After you have finished your selection, click on 'Checkout' and you will be asked for a few details that we need to be able to complete the order.

We accept credit card payment. If you are shopping from North America or outside the UK, place your order and your credit card company will convert the transaction to your own currency.

We accept Visa and Mastercard. We do not charge for any item until it is ready to ship. Backordered items are not charged until they are shipped.

When confirmation of order is received, this is to indicate that we have received your order. It does not indicate that a contract exists between us. We will indicate acceptance of your order, and hence a contract between us, when we send you an invoice. We have included this term to protect us in the case that a mistake has been made in pricing, we have inadvertently under-priced goods, or we are no longer able to supply a particular product for some reason. In the case of a change of price, we will always contact you first to ensure that the price is acceptable.

Delivery Schedule We will normally send your order to you in <3> business days . International orders are generally received in under <14> days.
However due to the massive range oif sizes we cannot stock them all so many items need to be ordered from the manufacturer. In this case orders will normally take 2 weeks depending on availability. You will be notified of any delays

Changing/Cancelling an Order

If you wish to amend/cancel all or part of your order, please Contact Us to make the desired changes. If your parcel has already been dispatched, simply return it to us within 14 days using the *pre-paid label. We will alter your order accordingly and re-dispatch it to you or provide you with a refund. (Subject to the provisions of clause 5 of our standard ‘Terms and Conditions’ ).

Your rights to return goods are protected under the EU Distance Selling Directive which can be found at www.hmso.gov.uk

Exchanges/Returns & Refunds

Each UK parcel will arrive with a first class freepost label to use should you need to return your order. We are happy to exchange or refund goods that are unworn and in a re-saleable condition with all labels in tact, so please do not remove these when trying on the items.

Should your garment prove to be faulty, we will either exchange or refund in accordance with the manufacturer’s standard 6 month guarantee.

Please ensure that the items are returned to us within 14 days of receipt for either an exchange or refund, which will be made to your original payment method. Postage & packaging costs are not refundable; however, you will not be charged for sending out 1-2 UK exchanges. (Please refer to ‘Delivery/Postage and Packaging’ charges above).

Returns and Refunds for Overseas Customers

We offer a 100% money back guarantee to our overseas customers. If you are unhappy with the goods that you have ordered, you may return them to us within 14 days of receipt. We do, of course, ask that the items be returned in a resalable condition and that they are unworn with all the original tags still attached. We respectfully ask customers to take care when trying on garments as we cannot refund items which are marked or carry strong odours. We will refund the full price of your order (excluding shipping costs) or exchange for another size or colour.
Please note that we do not carry carriage costs for returns for overseas customers as return postage to us is at your own expense. Shipping costs are excluded from refunds unless the goods are faulty. When sending items back to us you may be required to complete official forms or export documents. Please do not put the full commercial value but simply state RETURNING GOODS TO SENDER and put a nominal US$1 value. If you do not do this we may be asked to pay import and VAT charges by UK Customs, in which case we will have to refuse and your goods will be returned back to you.

To return an item


Fill out the ‘Exchanges & Returns Form’ supplied with your order.
Carefully fold the goods back into the original wrapping and box, remembering to include the ‘Exchanges & Returns Form’.
Reseal the box as before using the second seal sticker.
Stick the *returns label over your address on the box and post it back to us.

Price differences between exchanged goods will need to be refunded/added as applicable. Please Contact Us for details.

*When returning your parcel, we recommend that you obtain a free ‘Certificate of Posting’ from your post office ensuring that it’s stamped, as we cannot be held responsible for goods lost in transit.

Gifts



If you are purchasing items as a gift, please indicate on the checkout pages if you would like the item to be delivered to a different address (the invoice will be sent seperately to you). If you would like to include a short message then please send us an e-mail with your chosen wording.

Please adhere strictly to the instructions on the washing/care labels within each garment.
We always strongly recommend hand washing bras and fine mesh items to avoid damage and mis-shaping.

Back Orders If your item is not in stock, we will back order for you. You will always be emailed with the option to cancel your order if you would rather not wait.
